Emma Hendrie

Emma advises on contentious and non-contentious planning and environmental matters in the energy, housebuilding and commercial sectors across Scotland.

Her contentious experience includes advising clients on their appeals against non-determination and refusal of planning and Section 75A modification applications, statutory appeals, and petitions for judicial review in the Court of Session.

Emma is also skilled in the negotiation and drafting of planning agreements and modifications, and has advised a variety of clients on these.

  • During a secondment to SP Energy Networks, advising on consenting strategy for Section 37 consents, compliance with environmental legislation, and necessary wayleave applications.
  • Advising Miller Homes on its site at Mossend, West Lothian throughout the statutory appeal against refusal of planning permission by Scottish Ministers to the Inner House of Court of Session.
  • Advising clients on the judicial review process challenging decisions of Scottish Ministers and local authorities relating to the planning process. 
  • Advising clients on planning appeals to the Planning and Environmental Appeals Division including appeals against refusal of planning permission and for Section 75 modifications. 
  • Advising clients on submission of section 36 and section 37 applications including EIA reviews.
  • Advising energy, housebuilding and commercial clients on Section 75 Agreements and modifications.
  • Advising an energy generation developer and housebuilders on roads agreements under Section 96 of the Roads (Scotland) Act 1984.
  • Advising an energy generation developer on roads agreements under Section 96 of the Roads (Scotland) Act 1984.
  • Advising on the planning aspects of acquisitions of sites and units for housebuilders, energy developers and commercial clients.
