Alistair Kennedy

Alistair is highly experienced in procurement, construction and projects for private, public and third sector clients.

He is well-versed in tenders for projects of all sizes, and has assisted clients in relation to production and use of contractual frameworks for works and services. Alistair has extensive expertise in relation to construction contracts and sub-contracts, consultant appointment documentation, collateral warranties and performance securities such as performance bonds, retention bonds and parent company guarantees. He also has many years’ experience of drafting, negotiating and concluding contracts for large-scale public works on behalf of local authorities, funders and project companies.

  • Advising a large local authority in relation to contractor works framework agreements, including advice on the form of framework, preparing full contractual options for minor works, traditional procurement and design and build contracts (based around SBCC and NEC4 forms) so that the authority could deploy a single framework agreement in relation to works over a wide range of values. 
  • Advising a major port operator in relation to the contracts for numerous contracts, ranging from new developments to asset management work across UK sites based on NEC and considering port and marine specific requirements.
  • Advising a world-renowned sporting body in relation to redevelopment works at one of its historic properties and construction of a new global headquarters facility.
  • Acting for City of Edinburgh Council in providing advice relating to the redevelopment of Granton Waterfront, including advising on all construction documentation for the £4.75 million redevelopment of Granton Station and the £72.9 million Western Villages project which is intended to be Scotland’s largest operational “net zero” housing development.
  • Acting for City of Edinburgh Council in relation to the procurement of the West-East Link cycle route, including in respect of negotiations on interface with Network Rail-owned property.
  • Advising Capital Theatres in relation to the redevelopment of the King’s Theatre, Edinburgh – the theatre’s first in over 40 years. Leading in tailoring the construction contract to consider the specific requirements of the existing historic theatre building.
  • Advising housebuilders such as Taylor Wimpey and Miller Homes on bespoke building contracts and development agreements for the construction of affordable units for registered social landlords.
  • Advising a housebuilder and a registered social landlord in connection with building contracts, professional appointments (and associated collateral warranties and guarantees) for the recladding of existing units to address fire protection issues.
