Our expertise in agricultural tenancy matters is second to none. We have a thorough understanding of all the various forms of agricultural tenancy that currently exist under Scots law, and our team includes one of Scotland’s foremost legal experts on the subject. We are highly experienced in both contentious and non-contentious matters, and we frequently appear in the Scottish Land Court, representing landlords and tenants in a wide variety of disputes.

Share farming and contract farming can offer attractive advantages to both sides, but it is essential to fully and clearly document the arrangement from the outset. Not only does this ensure that everyone understands their responsibilities and obligations, it also avoids the serious legal and taxation consequences that can result if the Scottish Land Court or HMRC judges that the arrangement is a sham.

When necessary working closely with other key advisors such as land agents, agricultural consultants and accountants, we assist at every stage from creating legal documents to terminating agreements – and, if required, advising on ongoing management or any disputes along the way.
