Risk and Regulation
In an increasingly complex and active regulatory environment, our Partner-led service helps regulated businesses to maintain compliance and respond to incidents or interventions.
There can be significant consequences to failing to comply with regulations, trade sanctions or – in the case of bribery and money laundering – laws. Not just financial penalties, but real reputational damage too – many consumers prefer businesses that can demonstrate high standards in these areas, and this is also increasingly important to investors and pension funds. And, in some cases, even criminal proceedings.
Our team includes experts in trade sanctions and in all the key regulated areas, including energy, finance, health and safety, environment, employment, anti-corruption, healthcare, GDPR, sport, food and drink, competition, charities, pensions and technology. Many of them also have considerable experience of working with regulators or prosecutors, including on secondment. This gives us an additional perspective that enables us to provide practical advice, and to anticipate possible future regulatory changes.
Compliance
The best way to avoid regulatory intervention is to prevent incidents from happening. We provide strategic advice and guidance to help you put future-proof procedures and policies in place, and can help to evaluate your Board or risk committee from a regulatory perspective. We can also develop a bespoke monitoring system for you, providing specific and tailored updates on regulatory and compliance issues (internationally, if required).
Response
We advise on all forms of regulatory intervention, and have acted in many regulatory investigations with very significant potential consequences. This typically includes advice on public law challenges to regulatory decision-making, preparing legal briefings and position papers, and developing negotiating strategies.
