This article provides a summary of the long-anticipated case of Halliburton Company v Chubb Bermuda Insurance Ltd (Formerly known as Ace Bermuda Insurance Ltd) [2020] UKSC 48, handed down by the UK Supreme Court at the end of November. This case concerned arbitrator apparent bias, and the duty of an arbitrator to disclose information that may lead to doubts relating to their impartiality. Further, this case links to recent RICS guidance that will become effective from February 2021.

Adjudication update: the TCC confirms that an adjudicator’s failure to consider a defence of set-off was a breach of natural justice

It is settled in adjudication that, (1) only the dispute referred in the Notice of Adjudication may be decided by the adjudicator; and (2) a Respondent may advance any defence open to it (which may include set-off).

The Technology and Construction Court (“TCC”) has clarified how these two principles interact in the context of the valuation of an Interim Application.

Upper Tribunal provides further guidance on the terms that can be imposed in agreements under the Electronic Communications Code

In the recent decision of Cornerstone Telecommunications Infrastructure Limited v London & Quadrant Housing Trust, the Upper Tribunal was given a further opportunity to consider the terms to be imposed in an agreement under Part 4 of the Electronic Communications Code. With a particular focus on questions relating to sharing and upgrade rights, and the level of consideration to be paid under the agreement, the decision provides further clarity on the parameters for negotiation under the Code.
