Our in-depth technical knowledge of this complex market includes energy infrastructure and the recent connections reform, the price control framework, REMIT, the Capacity Market and Subsidy Control. This enables us offer clear and practical advice and, when required, to provide bespoke training for our clients in these areas.
The members of our team have extensive experience of acting for both energy businesses and regulators, including over 10 years in-house at the UK Energy Regulator, Ofgem. Our ability to view a situation ‘from both sides of the table’ gives us a different and valuable perspective.
We offer a comprehensive service that supports clients at all stages of the regulatory process. Helping them to engage with and shape policy development. Ensuring that they meet their compliance obligations – and can show that they do. Responding to requests for information. And successfully navigating any regulatory investigations. We have extensive experience of advising on ways to challenge decisions, including statutory appeals and judicial review, but these are not the only options, and we will always explore whatever route is most likely to lead to the best solution for our client.
Our expertise includes:
- Responding to regulatory monitoring exercises and enforcement investigations, including dawn raid simulations
- Drafting policies and procedures to enable compliance with regulation (such as REMIT or Licence requirements)
- Engagement with Ofgem, Department for Energy Security and Net Zero, and the National Energy System Operator on policy, regulation, and compliance
- Application of UK and EU rules on market manipulation
- Price Control experience, including appeals to the Competition and Markets Authority
- Advising on the implications of and options for challenge on code modification decisions (for example the Connection and Use of System Code or Grid Code modifications)
- Challenging decisions of the regulator including statutory appeals and judicial review
- Connections reform, including supporting Gate 2 applications
- Assistance in complying with regulatory cyber security measures under the Network Information Systems Regulations 2018
