Wi-Fi Terms of Use
Terms of Use of the Shepherd and Wedderburn Guest Wi-Fi
By using the Guest Wi-Fi service, you agree to comply with these terms of use (Terms of Use), as may be amended from time to time by us, Shepherd and Wedderburn LLP. If at any time you do not agree with the Terms of Use, you should not use the Guest Wi-Fi service.
Use of your personal data
- When you access the Guest Wi-Fi we will collect the online identifier of the device (eg John Smith’s iPhone or Jane Blogg’s tablet) that you are using to access the Guest Wi-Fi along with the media access control (MAC) address of the device. This will allow us to recognise you on future visits to Shepherd and Wedderburn premises.
- We shall use the online identifier and MAC address for the purposes of providing you with access to the Guest Wi-Fi and ensuring your compliance with the Terms of Use. We shall also use it to monitor the use of the Guest Wi-Fi, to ensure proper performance of the Guest Wi-Fi and to prevent unauthorised access. We shall not use the personal data you provide for marketing purposes.

- When you access the Guest Wi-Fi we will collect the online identifier of the device (eg John Smith’s iPhone, Jane Blogg’s tablet etc) that you are using to access the Guest Wi-Fi.
- When Wi-Fi is enabled on your device, your device will continuously broadcast the device’s presence to Wi-Fi hotspots that are within range. It does this by using a pseudo media access control (MAC) address unique to your device. This is different to the MAC address that is hard coded into the device at the factory. Pseudo means that information that can identify your specific device has been removed or altered to prevent identification.
- We shall use the online identifier and pseudo MAC address for the purposes of providing you with access to the Guest Wi-Fi and ensuring your compliance with the Terms of Use.
- We do not keep the online identifiers and pseudo MAC addresses for longer than 30 days and you will be regularly asked to confirm your agreement to the Terms of Use.

- Making use of the service
- This Guest Wi-Fi service (the Wi-Fi) is provided free of charge by Shepherd and Wedderburn LLP (we, us, our). We are a limited liability partnership incorporated in Scotland with registered number SO300895 and having our registered office at 1 Exchange Crescent, Conference Square, Edinburgh EH3 8UL.
- Before you can access the Wi-Fi you must confirm that you accept the Terms of Use and have read the privacy policy by clicking on the box where indicated on the Wi-Fi welcome page. If you do not accept the Terms of Use you won’t be able to use the Wi-Fi.
- The Wi-Fi is for use by those visiting our premises. Your access to the Wi-Fi is completely at our discretion and your access may be blocked, suspended, or terminated at any time for any reason including breach of these terms of use or breach of applicable laws or regulations. The actions described in these terms of use are not limited and we may take any other action we deem appropriate in terms of enforcing these terms of use.
- The Wi-Fi is to be used at your own risk. You acknowledge that S+W does not guarantee the security or availability of the Wi-Fi and that we may need to withdraw the Wi-Fi service for maintenance or other reasons requiring unforeseen downtime. The type, specification and condition of your device may also affect your use of the Wi-Fi.
- Your equipment may be susceptible to viruses and other harmful applications when the Wi-Fi is in use and you should ensure that you have appropriate virus checking procedures in place. We shall not be liable for any damage to your computer equipment caused by use of the Wi-Fi or unauthorised third party use.
- Acceptable Use
- You agree that in using the Wi-Fi you will comply with all applicable laws, rules and regulations and not use the Wi-Fi:
- in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
- to send, knowingly receive, upload, download, use or re-use any material which is offensive, obscene, pornographic, adult-oriented, hateful, discriminatory or inflammatory;
- to be threatening, abusive or to invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
- to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
- to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware
- in any way that may affect the running of the Wi-Fi or network or other technology connected to it; or
- in any way which may harm or damage our reputation or goodwill including any affiliate of us.
- We, in our absolute discretion, may control or restrict the types of materials which may be sent or received over the Wi-Fi and we shall use appropriate technology to enforce these policies.
- Liability
- You will be liable to us for all damages, losses, costs or expenses suffered by us arising out of any breach by you of these terms of use.
- To the maximum extent permitted by law we (which shall include any affiliate of us) exclude all liability for any damages, losses, costs or expenses which you suffer arising out of or in connection with the use or performance of the Wi-Fi service including in respect of any personal information that you send or receive while using the Wi-Fi. The limitation will apply irrespective of whether the damages arise out of breach of contract, delict/tort or any other legal form of action. We do not in any way exclude or limit our liability for death or personal injury due to negligence, or in respect of any other liability where it would be unlawful to do so.
- General
- We keep these Terms of Use under regular review. Where we update the Terms of Use you will be asked to agree to the updated version when you next log on to the Wi-Fi. These Terms of Use were last updated on 6 December 2024.
- These Terms of Use shall be governed by and construed in accordance with the laws of Scotland and the Scottish courts shall have non-exclusive jurisdiction to settle any dispute or claim arising in connection with your use of the Wi-Fi.
