Scotland’s target of reaching net zero by 2045 is an ambitious one, and the carbon market can make a big contribution. We are highly active in helping to achieve that vision.


We are very much at the forefront of this area: we’ve advised landowners, developers, charities and corporate entities on how to best structure and implement carbon-related projects. As a relatively new legal area that is evolving quickly, it has a lot of potential for innovative approaches, and we’re never afraid to try something new or different. We have framed bespoke contracts for the sale and purchase of carbon units that have been used across the market and in both Carbon Code and non-Code transactions. We also helped a client to part-fund a community buy-out by securing the remaining finance gap against carbon credits that would be generated by undertaking woodland projects following the purchase.

When additional expertise is required, we work closely with other teams around the wider firm, especially our experts in regulation and markets.

Our expertise includes:

  • Preparing carbon agreements, together with standard securities and conservation burdens
  • Acting in lease arrangements related to carbon capture schemes
  • Purchasing property for the purposes of carbon sequestration
  • Advising on the Woodland and Peatland Carbon Codes
