A power of attorney document, or PoA, can be a very valuable component of succession and estate planning. But it must be created with the necessary precision, taking account of all the particular considerations that apply in each case.

PoAs can grant permissions in two general areas: decisions about welfare, such as medical treatment, care, and where you live; and about financial affairs, such as managing your property, bank accounts and other assets. Within each of those areas, you’ll need to decide exactly what powers you do and don’t want to grant.

Clearly, deciding who to appoint as your attorney is also critical. It is often best to appoint several, in which case you must also decide whether they can act alone or must agree.
