A graduate, whose job offer from air traffic control was withdrawn because of his 6ft 10inch height, has lost an employment tribunal claim for indirect sexual discrimination. Although Ben Sargeaunt-Thomson, 24, had won a coveted place to train at the National Air Traffic Control Centre in Hampshire, health and safety assessors ruled it would be "dangerous" for him to have his 38-inch legs under his desk.

The Tribunal stated that he might experience discomfort while sitting at his desk, which would hamper his ability to carry out his job safely. A spokeswoman for NATS welcomed the decision, commenting that it was not feasible to fit a purpose-built desk for just one employee.
