Part 4 of The Employment Practices Data Protection Code which governs information
about worker's health was recently published. The Code does not impose new
obligations on employers, rather it is intended to operate to encourage employers
to adopt good practice and to comply with the Data Protection Act.
The code emphasises the rules on sensitive personal data which come into
play when an employer intends to process information on workers' health and
addresses the collection and subsequent use of information on workers' physical
and mental health or condition. A fuller note on the Code and the implications
for employers will be distributed as a separate bulletin next week.
