The EU draft consolidated jurisdictional notice aims to provide formal guidance on jurisdictional issues relating to mergers which fall under the EU Merger Regulation 139/2004. Once formally adopted it should enable firms to establish whether their operations are covered by EC control of concentrations, as currently regulated by the Notice of the same name. This concentration notice, along with the notice on the concept of full-function joint ventures; the notice on the concept of undertakings concerned; and the notice on calculation of turnover, will be repealed once the draft consolidated notice is adopted. In compiling this, the Commission has used its experience in applying the Merger Regulations of 1990 and 2004. The principles contained in the consolidated notice will be applied and further developed by the Commission as more cases arise.
