As well as producing guidelines for water mergers, the Competition Commission
has issued directions in relation to divestiture remedies in
mergers. The tool of ordering an undertaking to divest certain
businesses or assets in a merger inquiry is often used as a remedy
by the Commission and allows mergers to go ahead by limiting
competition concerns involved. The rules explain how the Competition
Commission makes its assessment in order to ensure that the divestiture
leads to an effective and proportionate result.
