The blocking of the acquisition of Portuguese gas incumbent, GDP, by
Portuguese electricity incumbent, EDP, and Italian ENI by the European
Commission was correct, according to the Court of First Instance. 
The court has ruled that the merger would have negative effects by
eliminating the competitive constraint that a gas incumbent like GDP
would have on the electricity market.  The ruling highlights the
importance of putting forward adequate remedies to the regulator. 
Remedies proposed promptly which address the competition issued
detected by the Commission is a necessity to attain clearance in cases
such as this.
